Do you need legal expenses insurance?

In short

Legal expenses insurance pays lawyer, court and expert costs if you have a legal dispute, for example with the landlord, the employer or after a traffic accident.

It is voluntary. It mainly pays off if a dispute would not be financially bearable for you. Watch out for exclusions and waiting periods.

GuideTo the answer in a few questions

Do you need legal expenses insurance?

Three questions, and you see whether legal expenses insurance can be worth it for you.

All answers at a glance

Do you already get legal advice through a union, a tenants' association or a professional association? Yes

First check what your association covers. Then you probably do not need the insurance. Ask your association which cases it takes on before you sign up for anything.

Is there already a dispute? Yes

It is too late for that. Existing disputes are never insured. A new insurance does not help you with this dispute.

Could you pay for a dispute over thousands of francs yourself? Yes

You usually do not need it. Legal expenses insurance mainly pays off if a dispute would not be financially bearable for you.

Could you pay for a dispute over thousands of francs yourself? No

It can be worth it for you. A basic package of private and traffic legal expenses costs between CHF 165 and 320 a year according to the consumer foundation. Watch exclusions, waiting periods, free choice of lawyer and limits on the amount in dispute. It pays the costs, but it does not guarantee success.

When is it worth it?

  • Yes, if you could not finance a dispute over thousands of francs yourself and no other protection exists.
  • Rather not, if you already get legal advice through a union, a tenants’ association or a professional association. Check that first.

What do you look out for when you sign up?

  1. Exclusions. A test by the consumer foundation rated five of eleven offers as inadequate, because of many exceptions in the small print.
  2. Waiting period. For many areas protection only applies after a few months.
  3. Free choice of lawyer. Not every policy allows it from the start.
  4. Limits on the amount in dispute. Small disputes are often excluded.

What does that mean in francs?

A basic package of private and traffic legal expenses costs between CHF 165 and 320 a year according to the consumer foundation. A single dispute in court can cost many times that, including the other party’s lawyer costs if you lose.

What many people get wrong

  • “With legal expenses insurance I win every dispute.” The insurer pays the costs, it does not guarantee success and can turn down hopeless cases.
  • “I will sign up when there is trouble.” Too late. Existing disputes are never insured.

Frequently asked questions

Does the insurer pay for a dispute that is already under way?

No. Only disputes that arise after the start of the contract are insured, often only after a waiting period of a few months.

What if I cannot afford a lawyer?

You can apply to the court for legal aid. It is granted if you lack the means and your case is not hopeless. You have to apply for it yourself.

What does a conciliation procedure cost?

The procedure before the conciliation authority is free in many cases, for example in rent disputes. Lawyer costs can still arise.
